Touchpoint Health Solutions, Tardis Medical, CustomPoint Recruiting, PDI and Phrequency,  together “our Company”, are committed to protecting the privacy and security of information that is obtained from you in connection with your access to websites under our operation and control, which includes this recruitment website (collectively, the "Site").   This Privacy Policy sets out how we use and protect any information we collect through the Site.

 

To proceed further on this recruitment website, you must review, acknowledge and agree to the statement of policy and terms and conditions set forth below (the "Privacy Policy") and acknowledge that you have done so by clicking "I agree". 

Please review the Privacy Policy carefully.  The Company reserves the right to change its Privacy Policy at any time, in which event the recruitment site will contain a notice of the change.  Changes will be effective immediately upon posting to the site.  Continued use of the Site after a change indicates your acknowledgement and acceptance of the Privacy Policy.  However, we will not use your personal data for purposes additional to the ones set forth below without your additional consent.

The Company is authorized to collect, use, access, transmit, store, process and disclose the information it obtains through your use of the Site, including but not limited to Personal Information, in order to process your application for employment or for the purpose of identifying you as a suitable candidate for future employment opportunities, as permitted by law and as described in the Data Privacy Notice below.  This includes sharing your personal data with third parties with whom we may do business.

  • This Site which includes this recruitment site does not extend binding offers or terms or conditions of employment.  Any employment offer that may result from your submitting information in response to a job opening listed on the Site is in accordance with the specific terms of that offer and is not based in any way on the description of the job on the Site.  Nothing on the Site shall be construed as a contract of employment or as a guarantee of continued employment or employment for any specific duration. 

 

Data Privacy Notice

 

The Company is regarded as a ‘Data Controller’. This means that we are responsible for how we hold and use the Personal Information about you. All applicable data protection laws shall be respected in full.

  

Any data collected through the Site, including Personal Information, will only be used for the purposes identified in the Site and within this Privacy Policy.

 

Personal Information means any information relating to an identified or identifiable living individual. For the purposes identified above we collect Personal Information such as your name, location and email address, your professional role, curriculum vitae, educational and employment history, phone number plus other details about how you heard about a job or role.

 

We are legally allowed to collect, store and process your Personal Information as you will have provided your consent for us to do so.  You will be made aware should our legal grounds for storing and processing your data change at any stage, for instance as a result of progression through our recruitment process, or should you become an employee.

 

For the purposes agreed, we may share your Personal Information with the affiliates within our group of companies.  We will not disclose your Personal Information to anyone else under any circumstances except as otherwise stated in this Data Privacy Notice, to successors in title to our business, to establish, exercise or defend our rights, or where required by law.

 

We have engaged certain third parties (“Data Processors”) who help with data storage, maintenance and processing.  Any processing of the Personal Information by these parties is in accordance with our instructions.  Personal Information will be accessed by these parties only to the extent that is necessary to fulfil our instructions and in compliance with applicable law, including with respect to data confidentiality, privacy and security.

 

Please contact privacy@touchpointsolutions.com if you want to see any Personal Information stored about you in our records or if you think that any of the Personal Information collected incorrect, confusing or incomplete.  You may also ask us to erase, restrict or port your Personal Information and you may tell us if you object to our use of your Personal Information and will honour any legal right to view, modify, restrict, port or erase your Personal Information in accordance with applicable privacy law.

 

Personal Information collected via the Site will be retained only as long as necessary and appropriate fulfil the purpose agreed and to comply with applicable legal standards.  If you are hired as an employee of the Company, this information may be transferred into an employee personnel file. Your information will be destroyed in accordance with the Company's record retention and destruction policy.
 

Your data may be transferred between the United Kingdom, European Union and USA.  The United Kingdom and European Union operate under the principles of the EU General Data Protection Regulations (“GDPR”).   The USA is not considered to have the same level of data protection. However, we ensure all data transfers comply with applicable legal requirements, for example under intercompany agreements with appropriate contractual protections.

Within the UK and EU jurisdiction, you may also lodge a formal complaint with your competent data protection authority.

 

If your application is for a role in the United States, this Privacy Policy shall be governed by the substantive laws of the State of New York, without regard to its conflict of laws principles.  If your application is for a role outside the United States, this Privacy Policy shall be governed by the substantive laws of England and Wales, without regard to its conflict of laws principles.

 

If any provision of this Privacy Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Privacy Policy, which shall remain in full force and effect.
  

 

UNDER NO CIRCUMSTANCES SHALL COMPANY HAVE ANY LIABILITY WHATSOEVER FOR ANY ERRORS OR OMISSIONS IN INFORMATION ON THE SITE, OR FOR ANY DAMAGES, LOSSES, OR EXPENSES THAT MAY OCCUR WHILE ACCESSING THE SITE, OR ANY LINKED SITE, OR THE INABILITY TO ACCESS THESE SITES; OR ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE; OR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES ARISING OUT OF THE BREACH OF THIS PRIVACY POLICY, HOWEVER OCCASIONED.
